Terms of Service

These terms apply to the Merchant Data website, dashboard and API (together, the "Service"), operated by RP Digital Marketing Ltd, trading as Merchant Data ("we", "us"), a company registered in England and Wales (company number 12265306). Registered office: 9 Pondside Close, Hurworth, Darlington, England, DL2 2NN.
By creating an account or using the API you agree to these terms. If you are using the Service for a company, you confirm you have the authority to agree on its behalf, and "you" means that company.
1. Who can use the Service
The Service is for business use only. You must be at least 18. We may accept or decline any request for access.
2. Free beta
The Service is currently a free, invite-only beta. That means:
- It is provided as it is. It may have errors, may change, and may be unavailable at times.
- Free credits have no cash value, cannot be transferred, and may expire when the beta ends.
- We may change, pause or end the beta.
- Our planned pricing is shown at merchantdata.in/pricing. You will never be charged unless you choose a paid plan.
3. Your account and API keys
- Keep your API keys secret. You are responsible for all use of your keys, whether or not you authorised it.
- If a key may have leaked, revoke it in the dashboard and create a new one.
- One account per person or company. Do not create extra accounts to obtain more free credits.
- Give us accurate account information.
4. Credits and limits
- API requests use credits as described in our documentation.
- Rate limits apply to every account and are stated in the documentation.
- Do not try to get around credit charges or rate limits.
5. What you may do with the data
We give you a limited, non-exclusive, non-transferable right to use the data you obtain through the Service for your own internal business purposes. For example, you may:
- research markets and businesses
- power internal tools and processes
- find and qualify potential customers, and add the data to your own CRM or internal tools
- use the data in analysis, reports and presentations, including reports you prepare for your own clients
6. What you may not do
You may not:
- resell, sublicense, publish or share the data in bulk, or give third parties access to it through your own API, database or product
- use the data to build or improve a product that competes with Merchant Data
- share your API keys or account with anyone outside your company
- collect data from the dashboard or website by automated means other than the API
- use the Service or the data in a way that breaks any law
- use the data to make decisions about individuals' credit, employment, insurance or housing
- use the data to harass anyone
- attempt to breach or test the security of the Service without our written permission
7. Contact details and your legal responsibilities
Some records include contact details that businesses have published, such as email addresses and phone numbers. It is possible that a fraction of these may relate to identifiable individuals, if the business chose to publicly advertise that on their website.
- You are solely responsible for how you use contact details, including following the marketing, anti-spam, telecom and privacy laws that apply to you and to the people you contact.
- You must honour any request to stop contacting someone.
- You decide for yourself how and why you use the data. For data protection purposes you act as an independent controller, not on our behalf.
8. Ownership
- We own the Service, the API, and the Merchant Data database as a compiled collection. These terms do not transfer any ownership to you.
- Brand names, logos and trademarks in the data belong to their owners.
- If you send us feedback or suggestions, we may use them freely without owing you anything.
9. Availability and changes to the API
- During the beta we make no commitment on uptime or support response times.
- We aim not to remove or rename fields in a published API version (for example /v1/) without notice. We may add fields and endpoints at any time.
10. Suspension and ending
- You can stop using the Service and close your account at any time.
- We may suspend or close your account if you break these terms, if your use puts the Service or others at risk, or if the law requires it. Where reasonable we will warn you first.
- After your account closes, you may keep using data you already obtained lawfully, for your internal business purposes only, and sections 5 to 9 continue to apply to it.
11. Our liability
- The Service is provided “as is”. To the extent the law allows, we exclude all implied warranties, including fitness for a particular purpose.
- We are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- Our total liability to you for all claims connected with the Service is limited to the greater of £100 or the amount you paid us in the 12 months before the claim arose.
12. Your responsibility for misuse
If a third party brings a claim against us because you used the Service or the data unlawfully or in breach of these terms, you will cover our reasonable costs and losses from that claim.
13. Privacy
Our Privacy Policy at merchantdata.in/privacy explains how we handle personal information.
14. Changes to these terms
We may update these terms. For significant changes we will email account holders at least 14 days before they take effect. If you keep using the Service after that, you accept the new terms.
15. Law and courts
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute.
